By accessing or using FrequencyOS ("the Platform"), operated by Resonance Agency LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

FrequencyOS provides marketing automation, customer relationship management (CRM), content creation tools, and business management services for wellness practitioners, coaches, and service-based businesses. Our platform includes but is not limited to:

• Contact and lead management
• Email marketing and automation
• SMS/text messaging services
• Content creation and scheduling tools
• Calendar and appointment management
• Course and membership delivery

3. SMS/Text Messaging Terms

IMPORTANT: By using our SMS services, you acknowledge and agree to the following:

3.1 Consent to Receive Messages

By providing your phone number and opting in to receive text messages, you consent to receive recurring automated marketing and informational text messages from FrequencyOS and our clients at the phone number provided. Consent is not a condition of purchase.

3.2 Message Frequency

Message frequency varies based on your interactions and preferences. You may receive up to 10 messages per month unless you have opted into specific campaigns with different frequencies.

3.3 Message and Data Rates

Message and data rates may apply. Your carrier's standard messaging rates will apply to all text messages sent or received.

3.4 Opt-Out Instructions

You may opt out of receiving text messages at any time by replying STOP to any message. After opting out, you will receive one final confirmation message. You may also contact us at support@frequencymarketer.com to opt out.

3.5 Help

For help with our SMS program, reply HELP to any message or contact support@frequencymarketer.com.

3.6 Carrier Liability

Carriers are not liable for delayed or undelivered messages. We are not responsible for messages that are not delivered due to carrier issues, phone number changes, or device incompatibility.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose
• Send unsolicited messages (spam) through our services
• Violate any applicable laws including CAN-SPAM, TCPA, and GDPR
• Impersonate any person or entity
• Interfere with the proper functioning of the platform
• Attempt to gain unauthorized access to any systems or networks

6. Payment Terms

Subscription fees are billed in advance on a monthly basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice.

7. Intellectual Property

All content, features, and functionality of the platform are owned by Resonance Agency LLC and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of content you create using our tools.

8. Limitation of Liability

To the maximum extent permitted by law, Resonance Agency LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

9. Indemnification

You agree to indemnify and hold harmless Resonance Agency LLC from any claims, damages, or expenses arising from your use of the platform or violation of these terms.

10. Termination

We may terminate or suspend your account at any time for violation of these terms. You may cancel your subscription at any time through your account settings.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the platform. Continued use after changes constitutes acceptance.
